Purchase Contract


When buying a kitten in our cattery, we will ask you to sign a contract on purchase.  It shows what your rights are after purchase should something happen to the baby as well as being proof of purchase and some "demands" on our side.

Buyers contract

By signing this contract, buyer and seller (further declared below) agree to uphold al terms and agreements stated. This contract is therefor upholdable in a court of law.

Purchase Price

Breeder acknowledges that upon signing this contract, the full purchase price has been paid to breeders bank account.

General Agreements
Breeder

  • Declares to be available at all times for advice, questions and mentoring.
  • Upholds the right to visit the cat. Should the cat be neglected in any way, shape or form or should the breeder have irrefutable proof Buyer is not adhering to Terms and Agreements stated in this contract. The breeder has full right to nullify the initial sale and receives the cat back. Breeder will then pay back purchase price (Minus a fine for not upholding the contract, as stated under "fines" below). Buyer is accountable for any and all transport costs resulting from breaking the contract and shipping back of the cat.
  • Is required to keep buyer up to date on changing contact information.

Buyer

  • Declares by signing that the cat will be kept in his or her ownership and is not acting as a liaison to a pet broker or 3rd person.
  • Will not give away the cat to a shelter or rescue or rehome without prior written agreement from breeder.
  • Will not rehome the cat through means such as craigslist, and always after written agreement from breeder.
  • If the cat is rehomed, buyer will provide breeder with the new owners contact information and vise versa.
  • Is required to keep breeder up to date on changing contact information.

Agreements concerning health of the cat

Breeder

  • Declares and acknowledges that to the best of her knowledge breeder only breeds with cats who are deemed free of any illnesses, parasites or hereditary diseases and acts accordingly to the terms and agreements and breeders code of the Limbra Cat Club as well as the CFA, with whom the breeder is affiliated. The knowledge of hereditary diseases is achieved by annual health testing of (grand)parents, and achieved through Echocardiograms done by a specialist. ANY living being can become ill.
  • Declares that to the best of her knowledge, the cat is healthy at the point of ownership transfer.
  • Declares that prior to flight, animals have been health checked and have been declared healthy and fit to fly.
  • Declares that over the course of time the cat has had multiple vet checks, a valid rabies vaccine, and has been completely vaccinated according to the Limbra Cat Club Vaccination schedule, and as is required before purchase/sale by the laws in the Netherlands.
  • Declares to have given the cat all necessary love, care, and attention needed for the cat to grow up into a social pet.

If, within 5 days of arriving into the care of buyer, a licensed veterinary specialist provides irrefutable proof that the cat suffers from a genetic hereditary disease, the buyer MUST bring this in to the attention of the breeder. If this condition is reason for the buyer to want to nullify the purchase, a fitting solution will be found to replace the cat. Buyer must provide breeder with irrefutable proof by a licensed veterinary specialist.

If within 18 months of arriving into the care of buyer, a licensed vet specialist provides irrefutable proof that the cat has died from a genetic, hereditary disease, the buyer MUST bring this in to the attention of the breeder. Only if buyer provides the breeder with a post mortem autopsy report stating the cause of death to be the hereditary disease, the buyer has a right to receive a new kitten, and pays just transportation costs of the new kitten. Buyer must provide breeder with irrefutable proof by a licensed vet specialist and pathologist.

If within 6 months of purchase the cat dies of FIP (feline infectious peronitis), he buyer has a right to receive a new kitten, and pays just transportation costs of the new kitten. Buyer must provide breeder with irrefutable proof by a licensed vet specialist and pathologist stating that the cause of death was FIP.

Breeder upholds the right to ask for a second opinion, on breeders costs, if she deems a second opinion might be of use. Breeder is not liable for any Vet or Vet specialist costs, unless discussed otherwise.

Care

Buyer is required to:

  • Take care of the cat to the best of her abilities, to keep the cat up to date on vaccines.
  • Take care of a clean source of drinking water, healthy food and a clean living environment.
  • Keep the cat indoors at all times, no free roaming is allowed. If no cat run or enclosure is present, a leash and harness is allowed.
  • NEVER declaw the cat or remove his vocal cords.

Cat Shows

In principle the cat is sold as a pet. Should buyer decide to take the cat to a cat show, the breeder will not guarantee any show success with the cat. Breeder is not liable for lack of success.

Breeding

The cat has been sold as a pet and thus is banned from being used as a breeding cat. On the pedigree there will be a written watermark stating the cat is not sold for breeding.

Should the cat be used to sire (pedigree less) offspring. A fine of $600 is claimable by the breeder per living kitten.

Advice

Breeder advises buyer to register the cats microchip into the countries main databases.

Contagious diseases

If, after point of sale the cat has come into contact with other cats or dogs, breeder isn't liable for any contagious diseases unless irrefutable proof exists the breeder is the source.

Penalty Clause

The terms and agreements of this contract are put into force by a fine of $600 upon breaking the contract.

Two copy's of this contract are to be signed and valid upon signing. All costs for a lawsuit that come into existence through breech of contract are on buyers account. One copy of this contract is handed to the buyer, together with all necessary documents and the pet passport.
